1. The Service

SmartKartoffel is an AI-powered German language learning assistant available at smartkartoffel.com. We provide grammar corrections, vocabulary tools, pronunciation grading, and learning features powered by AI.

2. Your Account

• You must be at least 16 years old to use SmartKartoffel
• You are responsible for keeping your password secure
• You may not share your account with others
• You may not create multiple accounts to bypass the free message limit
• We may suspend accounts that violate these terms

3. Free Plan

The free plan includes 10 messages to try the service, basic AI corrections, and saving up to 10 words. After 10 messages, an upgrade to Pro is required to continue. We reserve the right to adjust free plan limits with notice.

4. Paid Plans (Pro & Business)

• Pro: €14.99/month or €125.90/year — unlimited messages, all features
• Business: €49.99/month or €419/year — unlimited messages, priority support
• All plans include a 3-day free trial — you will not be charged during the trial
• After the trial, your card is charged automatically unless you cancel
• You can cancel anytime from within the app — access continues until the end of the billing period
• Payments are processed securely by Stripe

5. Refund Policy

We offer a 7-day refund on your first payment if you are not satisfied. After 7 days, payments are non-refundable. To request a refund, email info@smartkartoffel.com within 7 days of your charge.

6. Acceptable Use

You agree not to use SmartKartoffel to:

• Submit illegal, harmful, or offensive content
• Attempt to reverse-engineer or scrape the service
• Overload our servers through automated requests or abuse
• Resell or commercialise access to the service without written permission
• Impersonate other users or SmartKartoffel staff

7. AI-Generated Content

SmartKartoffel uses AI (Claude by Anthropic) to generate responses. While we aim for accuracy, AI-generated content may occasionally contain errors. Do not rely solely on SmartKartoffel for critical language decisions (e.g., legal or medical translations). We are not responsible for errors in AI-generated content.

8. Intellectual Property

The SmartKartoffel brand, logo, and design are our property. The content you submit (your sentences, words, feedback) remains yours. You grant us a limited licence to process your content to provide the service.

9. Availability

We aim for high availability but cannot guarantee 100% uptime. We may perform maintenance that temporarily makes the service unavailable. We are not liable for losses caused by downtime.

10. Limitation of Liability

To the maximum extent permitted by law, SmartKartoffel is not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability is limited to the amount you paid us in the last 3 months.

11. Changes to These Terms

We may update these terms. We will notify you by email at least 14 days before significant changes take effect. Continued use after that date means you accept the new terms.

12. Governing Law

These terms are governed by the laws of Germany. Any disputes will be resolved in German courts.
